ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS

The detailed general terms and conditions of sale below (hereinafter referred to as the "General Terms and Conditions") govern the contractual relationships between any user of the MCZDIRECT™ website (hereinafter referred to as a "Customer") and the commercial brand MCZDIRECT™.

These general terms and conditions of sale are the only ones applicable and replace all other conditions, except for prior, express, and written derogation. MCZDIRECT™ may occasionally modify some of the provisions of its general terms and conditions, so it is necessary that these be read before each visit or order from the MCZDIRECT™ website (hereinafter referred to as the "Site"). These modifications are binding as of their posting online and cannot apply to contracts concluded previously. Each purchase on the Site is governed by the General Terms and Conditions applicable on the date of the order. We consider that by validating your order, you unreservedly accept our general terms and conditions of sale after having read them. By accessing the Site, you commit to respecting the General Terms and Conditions as well as the Conditions of Use listed therein.

EFFECTIVE DATE

These general terms and conditions come into effect on the date of the order form's signature. These general terms and conditions are concluded for the duration necessary for the provision of the subscribed goods and services, until the expiration of the guarantees owed by the MCZDIRECT™ company.

GENERALITIES

We are a dynamic team based in Hong Kong and Singapore. We market products that we have in stock or that are immediately available from our various suppliers. All our products are carefully selected and controlled to provide you with total satisfaction.

TAXES

We are exporters, our prices are without VAT, all products are shipped from Hong Kong. Therefore, no tax will be required by the transport company for delivery in Europe or following this delivery. Our company MCZDIRECT™, not being subject to VAT, we are unable to provide an invoice including VAT.

EMAILS

In a bid to always satisfy you, we strive to respond to each email within a maximum of 6 hours. We are available and attentive to your needs, and we will be pleased to find solutions adapted to each situation to meet your needs. Please check your spam folder especially for the following email services: GMX, AOL, WEB.de, Freenet, Hotmail, Thunderbird, Gmail. All our emails are sent to the address provided when creating your account on our MCZDIRECT™ website.

PRICES

The sales prices indicated on the site are in euros (€) with delivery costs included. Delivery is free of charge across the entire site. The total amount is indicated to the customer at the end of the ordering process before confirmation of their acceptance. We reserve the right to modify our prices at any time, but we commit to applying the rates indicated on the site at the time of your order. No discount will be granted if in the meantime the product price should decrease. If an item is sold with a manifest price input error that the customer could not in good faith ignore (article 1109 of the Civil Code), we reserve the right, according to current legislation, to cancel the order and refund the customer. We will inform you as soon as possible. You will then be able, if you wish, to place your order at the corrected and exact price.

PAYMENT

The user also has the option to pay the amount of their order by bank transfer to our European bank account with IBAN. The transfer fees are at the customer's expense. (Free in most cases, depending on banks)

DESCRIPTION

We take the utmost care in accurately describing the information on each of our products, however, they are provided for indicative purposes only and we remain fully available to the customer for any clarification on the details of each product. The photos are non-contractual. As our products are direct imports from Asia, the package content does not necessarily include a user manual in your language, but we systematically provide you with this notice in the language of the country of destination of the order in PDF format. We will send you an email with the download link.

QUALITY CONTROL BEFORE SHIPMENT

Please note that all packages are opened before shipment for a quality control by our order preparers. They check the menu language, the new condition of the equipment and add the power cable or adapter necessary for the country of destination of the order. This quality control and the order preparation are filmed for security reasons.

AVAILABILITY

Please note that we will honor your order within the limits of our available stock. Our offers are valid subject to availability from our suppliers. In case your order is unavailable, in the event that one of the ordered products is not available in our stock, we commit to contacting you by email within 15 days

 from the date of your order to inform you and indicate in what time frames this product could, if necessary, be delivered. It is also possible to cancel the order and refund you within a period of 3 to 4 business days following the cancellation date of your order.

DELIVERY

Shipping costs are free for delivery within the European Union. Products are delivered to the address indicated by the user on the order form. We will regularly inform the customer of the progress of the payment and delivery. The average delivery time is 6 to 12 working days. All our orders are sent with a signature required. As soon as the carrier takes charge of the order, a tracking number will be transmitted to you.

ABSENCE ON THE DAY OF DELIVERY

Depending on the case, the carrier may leave a notice in the customer's mailbox, inviting them to contact the carrier or the nearest depot to their home. This situation is usually indicated on the delivery organization's website. It may happen that the notice is not found by the customer, then it is their responsibility to track their package online to be informed of the situation as soon as possible.

STRIKE OR FORCE MAJEURE EVENT

MCZDIRECT™ makes every effort to respect all its commitments, including the delivery time mentioned on the site. However, we cannot be held responsible in case of a strike by the transport services or any other event of an exceptional nature that slows down or prevents the delivery of parcels. In case of non-receipt of a package within the indicated deadlines, an investigation is carried out with the carrier and can take several days. During this period, no refund or reshipment can be made. At the end of this investigation, and if it indicates a failure of service by the carrier, the customer will be fully refunded or the product will be reshipped, according to the customer's wish. Upon receiving your package, please check the conformity of the delivered products with your order and indicate to us, if necessary, on the delivery slip and in the form of handwritten reservations accompanied by your signature, any anomaly concerning them.

IN CASE OF LOSS/THEFT DURING DELIVERY

If the package is lost by the carrier or if the merchandise inside the package was stolen during transit, contact us immediately. We will then transmit the serial number of the equipment so that you can file a complaint against the carrier at the nearest police station. Please send us a copy of the police report that will be given to you, along with a copy of an identification document and other documents. Please contact our logistics service to inform us of the problem encountered so that we can be as reactive as possible. We can refund you in full only upon receipt of these elements. Unfortunately, we will not proceed with sending a new package in the case of theft during delivery, as we prefer to wait for the end of the investigation carried out by the carrier, which can take several months.

RESERVATION OF OWNERSHIP

The MCZDIRECT™ company remains the owner of the delivered goods until their complete payment by the customer. The foregoing provisions do not prevent, from the delivery of the goods, the transfer to the customer of the risks of loss or deterioration of the goods subject to reservation of ownership as well as the damage they could cause.

WARRANTY AND RETURN

a) We wish to inform our clientele that all the products offered on our platform, MCZDIRECT, are imported. Due to the lack of international warranty provided by the manufacturers, the manufacturer's warranty may not be applicable in some cases.

MCZDIRECT's Commitment

To overcome this limitation, MCZDIRECT offers a specific seller's warranty for all products sold within the European space, in compliance with European regulation. The duration of this warranty varies according to the country of purchase:
- Portugal and Spain: 3 years
- France, Belgium, and other EU countries: 2 years

This warranty covers manufacturing defects from the date of invoicing. In case of defect or malfunction, customers must contact our service and return the product for repair. Repairs, including labor and spare parts, will be carried out by our service partner before returning the product in working condition.

Return Procedure to the Service Center

It is crucial to contact MCZDIRECT before any return to the service center to avoid additional costs. To initiate a return under warranty, contact us through contact@mczdirect.com to receive all necessary instructions. The shipping costs to our service partner are at the customer's expense, while the return of the repaired product is covered by MCZDIRECT.

Warranty Exclusions

The warranty does not cover damages due to:
- Non-conforming use of the product.
- Damages resulting from impacts, shocks, falls, presence of sand, dust, dirt, humidity, leaks from batteries or cells, fires, thefts, attempted thefts, acts of vandalism, war, terrorism, corrosion, contamination, water infiltration, frost, floods, winds, earthquakes, storms, or any other extreme weather condition.
- Accidentalor intentional damages.
- Damages due to exposure to humidity or extreme temperature conditions.
- Incorrect use, inadequate storage, or improper handling of the product.
- Damages related to the cleaning of the product (dust, sensor, lenses, etc.).
- Damages caused by using the product with a power source of incorrect voltage.
- Violation of the terms of this warranty or the contract.
- Non-compliance with the written instructions provided with the product, or those of the manufacturer.
- Damages or defects resulting from negligence by anyone other than us.
- Loss of quality, degradation of performance, or damages resulting from the use of spare parts or other components (such as consumables) not produced nor recommended by the manufacturer.
- Damages or defects resulting from modifications to the product and/or its software carried out by a person other than our authorized representatives.
- Alteration, illegibility, or modification of the product's serial number.
- Damages or defects resulting from connecting the product to equipment, accessories, software, or networks not approved by the manufacturer.
- Damages due to external causes beyond our control, including but not limited to accidents, fires, or burglaries.
- Repairs or cleaning of the product carried out with inappropriate tools or according to incorrect procedures.
- Defects resulting from the attempt to open the product casing for autonomous repair.
- Loss or damage of data.
- Damages or defects resulting from connecting the product to a network not approved by the manufacturer, or unauthorized modifications of your operating system or network.
- Damages to the display screen (LCD) due to improper use.
- Damages occurring due to inappropriate packaging during shipment to the service center or the service agent.
- Damages resulting from the use of waterproof cameras or waterproof casings at depths exceeding those recommended.
- Dead pixels not declared within 14 days of receiving the item.

Note on Third-Party Lenses

MCZDIRECT covers repairs due to manufacturing defects, excluding problems related to third-party lenses. The use of such lenses is at the discretion of the user, without warranty on our part regarding the quality or reliability of focus. In case of a problem, MFA tools must be used, and both the camera and the lens must be sent to the manufacturer for inspection.

Protecting Your Product

We recommend removing any memory card or non-essential accessory before returning the product to us, as MCZDIRECT cannot be held responsible for the loss of data or accessories.

This communication aims to ensure total transparency regarding the warranty coverage offered by MCZDIRECT, in order to maintain the trust and satisfaction of our clientele.

b) You have up to 14 calendar days to return the order to us in its original condition. You must return it to our return address in Hong Kong. Please make the request by email. Note that for this, the product must not have been used or show signs of use, whether physical or internal. Products must be returned in their state: new, with all accessories and protective films allowing a re-sale as new. Upon receipt and verification of your return, you will be refunded. If not, the return will be refused. The transport costs will then be billed to you.

Regarding accessories such as batteries, filters, memory cards, etc.: if the packaging has been opened, we will not proceed with a refund or exchange.

If you notice a malfunction or failure within 14 days following delivery, you can return the product to us free of charge under the same conditions as paragraph "b)". The product must be returned in the same conditions of receipt. The product, accessories, and packaging must be intact.

Otherwise, we will not proceed with an exchange/refund but with a Service After Sale treatment. If the origin of the malfunction turns out to be a handling error, a shock, or contact with water, we will send you a quote to repair the product or return it as is, plus a package of 59 € to cover diagnostic fees and transport costs.

If in the case of a return within 14 days, the product shows signs of inappropriate use, shock, or deterioration, or if accessories delivered with the device are missing, we will not proceed with an exchange, we will treat the fault through our Service After Sale, and it will be returned to you under the same conditions as paragraph "a)".

If you wish to cancel the sale while the package is already in the process of being shipped but has not yet been delivered, the cancellation fees for delivery and return to the sender will be deducted from the refund of your purchase.

PERSONAL DATA PROTECTION

The information you provide is essential for the processing and shipping of orders, the issuance of invoices, and warranty contracts, its absence results in the cancellation of your order. By registering on our MCZDIRECT™ site, you commit to providing us with sincere and true information about yourself. The communication of false information is contrary to these general terms and conditions as well as to the conditions of use listed on the Site. Thus, you authorize MCZDIRECT™ to collect, process, and use the information concerning you.

Of course, you have a permanent right of access and rectification of all your personal data, in accordance with European texts and national laws in force (article 34 of the law of January 6, 1978). You can at any time make a request to MCZDIRECT™ to find out what information we hold about you, and you can modify this data at your discretion. If you accepted it when identifying yourself on the Site, promotional emails offering novelties, clearance offers, exclusives, bargains, or simply to inform you of the news, will be sent to you. You can request to stop receiving these emails at any time by clicking on the link provided for this purpose and inserted at the bottom of each of the emails that will be sent to you, or by going to our customer area in the section "Personal Information".
